Plaintiff underwent spinal surgery for the injury he sustained at work on December 17, 2022. On February 27, 2025, Plaintiff’s surgeon faxed a note to Defendant regarding Plaintiff’s surgery. This note was also sent to Defendant via certified mail on March 4, 2025. 39. On March 10, 2025, Defendant abruptly terminated Plaintiff’s employment for the pretextual reason that Plaintiff did not provide satisfactory medical documentation. At the time of his termination, Plaintiff was on protected FMLA leave.
